Terms and Conditions

Please read these terms and conditions carefully before accessing our website. By accessing or using any part of the site you agree to be bound to these terms of service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any of its services.

None of the items purchased from Blue Moon Curiosities are for human or animal consumption unless stated on the packaging. 

Please keep all items and packaging away from pets, babies, and children.


Definitions

 “Buyer” means the individual or organisation who agrees to buy goods from the seller

 “Seller” means Blue Moon Curiosities of 19 West Park Road, Newport, NP20 3EH

 “Consumer” shall have the meaning as ascribed in section 12 of the unfair contract terms act 1977

 “Contract” the contract between the Buyer and the Seller for the sale and purchase of goods incorporating these terms and conditions.

 “Goods” means the articles that the buyer agrees to buy from the seller

 “Terms and conditions” mean the terms and conditions of sale set out in this agreement and any special terms and conditions agreed in writing by the seller.

Conditions

Nothing in these terms and conditions shall affect the buyer’s statutory rights as a consumer.

Acceptance of delivery of goods shall be deemed evidence of the buyer acceptance of the terms and conditions.

Any complaints should be addressed to the seller’s address stated in clause above.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the service, violate any laws in your jurisdiction (including but not limited to copyright laws.)

You agree to not reproduce, copy, sell, resell, or exploit any part of the service without any written permission by us.



Your Account

The buyer is responsible for all aspects of the account with us. Please keep password safe and do not pass onto any third parties.

Ordering

When making an order through the website, the technical steps the Buyer needs to complete the order are clearly stated.

Orders placed by you are an offer to purchase and will be accepted by us, we never allow an item to appear for sale if it is not in stock and available to ship immediately. In the unlikely situation that you purchased an item that is out of stock (craft Fayres) we will contact you and offer an alternative or a full refund along with our apologies. Therefore, we state that all items displayed for sale are subject to stock availability. The contract of the sale of the goods will not be formed until delivery of the goods to you at the address that you give us. We retain the right to treat items ordered as separate orders.


Price and Payment

The price of Goods shall be that stipulated on the Website. The price is inclusive of UK VAT and exclusive of delivery charges.

We accept Credit Card and Debit Card payments via our website. Cards we accept: (MasterCard / Visa / Visa Delta / Visa Electron / Maestro / Solo / Switch). We also accept PayPal for all orders.

Payment of the price and delivery charges where appropriate, must be made in full before dispatch of goods.


Age of Consent

Where goods may be purchased by a person of a certain age, the Buyer will be asked when placing an order to declare that they are of an appropriate legal age.

If the Seller discovers the Buyer is not legally entitled to order these goods, the Seller is entitled to cancel the order immediately, without notice.


Shipping

Goods in stock will normally be dispatched within 3 working days of acceptance of an order.

In the UK, postage and packing is worked out by the weight of your order.

We use a number of carriers depending on the weight and destination of each order.


Import duties

For delivery addresses outside of the UK the Buyer may be subject to import duties and taxes which are levied once a shipment reaches your country. Any such charges must be borne by the Buyer. Please be aware that international shipments are subject to opening and inspection by customs authorities.


Returns

Non-returnable items include personalised items and custom orders and also include perishable goods such as room sprays.

Contact us within 7 working days from the day after delivery and return the goods within 14 days.

Return to us with the products in their original packaging and labels

All goods must be in a new and unused condition together with a copy of your original receipt no refund will be issued if conditions not met.

Your statutory rights are not affected


Security

In order to protect your personal information, we take reasonable precautions to follow best practice making sure it is not inappropriately lost, misused, disclosed, accessed altered or destroyed. Your personal data will not be passed onto any other party in any circumstances.

For any payments which we take from you online we will use a recognized online secure payment system.

We will notify you promptly in the event of any breach of your personal data which might expose you to serious risk.


Warranty

Crystals and minerals are sold as seen and can be brittle and contain flaws as produced by nature. Colour and structure may alter over time, Buyers should consider this when buying.

Whilst every effort is made to ensure the pictures and colours on the site match as closely as possible those of the actual product due to technical limitations, some colours may vary.

Please note we cannot accept any responsibility for damage as a result of misuse.

Any claim under breach of warranty must be made within 14 days of the defect or fault by the Buyer. The Buyer must return the goods to the buyer at a cost to the Buyer.

Privacy

Under the GDPR, we must always have a lawful basis for using personal data.

This may be because the data is necessary for our performance of a contract with you, because you have consented to our use of your personal data, or because it is in our legitimate business interests to use it. Your personal data may be used for the following purposes:

Providing and managing your order

Providing and managing your access to our Site

Supplying our products to you. Your personal details are required for us to enter into a contract with you.

Communicating with you. This may include responding to emails or calls from you.

Analyzing your use of our Site and gathering feedback to enable us to continually improve our Site and your user experience.


Changes to Terms and Conditions

The Seller shall be entitled to alter these Terms and Conditions at any time but this will not affect the existing Terms and Conditions accepted by the buyer upon making a purchase.


Governing Law

These Terms and Conditions shall be governed in accordance with the laws in England and Wales and the parties hereby submit to the exclusive jurisdiction of the Welsh courts.
